Occupational Health and Safety in the New eSocial in 2021

The Government has just published Joint Ordinance No. 82, which approves version S-1.0 of the layout and the Guidance Manual of the new eSocial. See what changes in Occupational Health and Safety in the New eSocial in 2021.

Now, OHS will finally become part of the New eSocial starting in June 2021.

In the 1st version of NDE 01/2018, in addition to the social security information necessary to compose the PPP and CAT, labor information was also required, such as:

• Programs, Plans and Documents required by the Regulatory Standards - NR;
• All training required in the NRs; and
• Information from unhealthy and hazardous condition reports...

However, after many discussions in 2019, it was decided to start simpler. The OHS version in eSocial, which should come into effect in June 2021, will be leaner, basically covering the information necessary to compose the CAT and the PPP.

OHS layouts in the New eSocial of 2021

First of all, the OHS layouts, which had already reached six events, now Occupational Health and Safety in the New eSocial in 2021 brings only three OHS group events in the 2021 eSocial layouts. They are:

• S-2210 - Work Accident Communication
• S-2220 - Worker Health Monitoring
• S-2240 - Work Environmental Conditions - Harmful Agents

These are the necessary pieces of information to prepare the Work Accident Communication - CAT and the Social Security Professional Profile - PPP.

OHS schedule in the New eSocial

In advance, according to the Implementation Schedule, this is the current eSocial schedule:

Group 1 - Companies with revenue above R$78 million

• Table, non-periodic and periodic events - already implemented
• 06/08/2021 - OHS Events - Worker Health and Safety

Group 2 - Companies with revenue below R$78 million, except those opting for SIMPLES

• Table, non-periodic and periodic events - already implemented
• 09/08/2021 - OHS Events - Worker Health and Safety

Group 3 - ME and EPP opting for SIMPLES, MEI, individual employers (except domestic), non-profit entities

• Table and non-periodic events - already implemented
• 05/01/2021 - Periodic Events (payroll) - S-1200 to S-1299  
• 01/10/2022 - OHS Events - Worker Health and Safety 

Group 4 - public bodies and international organizations:

• 07/08/2021 - Only information related to the bodies, that is, employer registrations and tables
• 11/08/2021 - In this phase, entities become required to submit information related to public servants and their links with the bodies (non-periodic events). Examples: admissions, leaves and terminations
• 04/08/2022 - Submission of payrolls becomes mandatory (for the entire month of April/2022)
• 07/11/2022 - In the final phase, occupational health and safety (OHS) data must be sent

The new Table 24 - Risk Factors and Activities - Special Retirement

Since version 1.0 Beta of the layouts, released in February of this year, the famous table 23 is no longer an OHS table.

The new Table 24 includes only the social security risk factors considered for special retirement. Therefore, only the harmful agents considered in the LTCAT and PPP need to be reported.
The table 28 - Hazardous, Unhealthy and/or Special Activities was also excluded. Special activities moved to the new Table 24.

Conclusion

The OHS part of the new eSocial will start simple. After companies become used to the new system and the revised NRs, labor OHS obligations will be added.
